Exterior modifications & alterations

Per Declaration of Unit Ownership Article V and Rules & Regulations Rules 12–13: no exterior additions, changes, or alterations may be made without prior Board or Association approval. Unauthorized modifications may void the Association's maintenance responsibility for affected areas.

Can I install or modify exterior doors, windows, or walls? Board approval required

No modifications to exterior doors, windows, or walls may be made without prior written Board approval. Each unit's boundaries include the unexposed surfaces of the drywall and exterior surfaces of windows, window frames, and exterior doors — any alteration must be approved.

Can I install a storm door or screen door? Board approval required

Storm doors and screen doors may be permitted but require written Board approval of the style and color prior to installation. Submit your request to thewindingcreekhoa@gmail.com with a product description and color sample.

Can I put up an outside antenna or satellite dish? Board approval required

Outside radio, aerial, or television antennas, satellite dishes, and window air/heat units are not permitted without a written request submitted to and approved by Association Management. See the Winding Creek By-Laws for full requirements.

Can I install a window A/C unit? Board approval required

Window A/C units may be authorized under special conditions. A written request must be submitted to and approved by Association Management prior to installation.

Rule 13
Can I put up any signs, ads, or lettering on my unit? No

Signs, ads, or lettering will not be exhibited or affixed to any door, building, or elsewhere by residents. This includes "For Sale," "For Rent," or any other signage.

Rule 12
Can I put aluminum foil, reflective material, or dark coverings in my windows? No

Window coverings must have a white backing as seen from the outside. Storm doors must be full view. No materials that alter the exterior appearance of the building from outside are permitted without Board approval.

Can I erect a tent or temporary structure on my patio or common area? No

No temporary structures may be erected on patios or common areas. Common elements may not be altered by any owner or tenant without Board approval.

Can I alter or improve the common area outside my unit? Board approval — limited

Planting of flowers and bulbs on common grounds is encouraged. However, no construction, permanent shrub planting, or removal of existing plantings is permitted without Association approval.

Can I make structural changes to the inside of my unit? Board approval required

No owner shall do any work that would jeopardize the soundness or safety of the property or reduce its value. Any work that affects shared walls, roofing, or structural elements requires Board approval. The Association must be notified before any major interior renovation begins.

Parking & vehicles

Per Rules & Regulations Rules 2–4: Winding Creek has specific parking policies to maintain safety and fair access for all residents.

Where can I park? Yes

Two spaces per unit are provided as marked directly in front of each unit, except efficiency unit 553C, which has one space. Overflow parking is at the lower end of parking areas and along Winding Creek Road.

Rule 2
Can I park in yellow-marked areas or near dumpsters? No

Do not park within 20 feet on either side of street entrances or in front of dumpster areas. Yellow-marked areas are designated NO PARKING per the City of Fayetteville Fire Prevention Code. Vehicles in these areas will be towed at the owner's expense.

Can I park a boat, trailer, RV, or commercial vehicle? No

No boats, trailers, mobile homes, or commercial vehicles may be parked overnight on the grounds without prior written consent of the Board.

Are there vehicle size limits? Yes

All vehicles must currently be registered, licensed, and in operating condition or they are subject to towing at the owner's expense. Oversized or inoperable vehicles must not remain on the property.

Rule 2
Can I repair or wash my vehicle on the premises? No

No vehicle repairs, grease changes, or oil changes are allowed on the premises. Water faucets at the end of buildings are for watering grass and shrubs only — not for vehicle washing.

Rule 3
Can I drive on the sidewalk or grass? No

No cars, trucks, motorbikes, bicycles, or other vehicles shall be driven on the sidewalks or grass. All such vehicles must be parked in designated parking areas.

Rule 2
Can I ride a motorcycle or motorbike on the property? Limited

Motorcycles and motorbikes are permitted for ingress and egress only. Any motorcycle or motorbike without a fully operational muffler may not be operated on the premises at any time.

Rule 4
Can I ride skateboards, bikes, or scooters in common areas? Limited

Skateboarding is not allowed in unit parking areas, sidewalks, or any other common area. It is permitted in the pool parking area only if no cars are parked there and the privilege is not abused. Skateboarders must keep the area policed and leave no trash.

Rule 17
What happens if my neighbor parks in my space? Contact management

Do not confront neighbors directly. Contact management at thewindingcreekhoa@gmail.com or 910-987-2573 and we will address the situation. You may be asked to reach a courteous agreement with your neighbor if you have extra space.

Rule 2

Pool access & rules

Per the Pool Rules adopted by the Winding Creek Homeowners Association: the pool is for resident use only during posted hours, and a pool access key is required at all times when using the pool.

Can I use the pool? Yes

The pool is for the exclusive use of residents and their guests. Your pool access key must be in your possession at all times when using the pool. No key — no access.

What are the pool hours? 10 AM – 10 PM

Pool hours are 10:00 a.m. to 10:00 p.m. during pool season (May through September). Anyone in the pool area outside of these hours is considered trespassing.

Can I bring guests to the pool? Yes — limits apply

Residents are limited to two (2) in-town guests. There is no limit on out-of-town guests provided they are pre-registered with the Association Manager before arrival. The resident must be present at all times while any guests are at the pool.

Can children use the pool without an adult? No

Children under 13 years of age are not permitted in the pool area unless accompanied by an adult over the age of 18. Any child under 13 observed in the pool area without an adult may result in loss of pool privileges for the entire household.

Can I bring glass containers to the pool? No

No glass containers of any kind are permitted in the pool area. Anyone found with glass (except eyewear) will lose pool privileges for the remainder of the pool season. Plastic containers, pop-tops, and cans must be disposed of in proper waste containers.

Are pets allowed at the pool? No

Absolutely no pets or animals are permitted in the pool area or in the pool at any time.

Do I need to shower before entering the pool? Yes

Showers are required before entering the pool. Suntan oils and lotions can permanently damage the filter system and are not to be used before entering the water.

Is there a lifeguard on duty? No

There are no lifeguards on duty at any time. All residents and guests swim entirely at their own risk. Be safe.

What music and noise rules apply at the pool? No blaring music

No loud or blaring music is permitted. Please use the facility in a normal, quiet manner to allow maximum enjoyment for all residents and guests.

What conduct is prohibited at the pool? Prohibited

No running, rough playing, splashing, foul language, lewd or lascivious behavior, Frisbees, bikes, scooters, skates, or skateboards are allowed in the pool area. Proper swimwear (bathing suits) is required at all times — no cutoffs are permitted. The pool gate must be kept closed at all times.

Can I access the pump house? No

Only authorized personnel are permitted in the pool pump house. Unauthorized entry is prohibited.

Can pool privileges be suspended? Yes

Association staff members may suspend pool privileges if any resident or guest is found violating pool rules. The Association will not tolerate illegal drug use or underage consumption of alcohol and will cooperate fully with law enforcement.

Who is responsible for cleaning up at the pool? You are

Each resident is responsible for policing and cleaning up after themselves — including cigarette butts, candy wrappers, and any other refuse. Failure to do so may result in being billed for clean-up services.

Pets

Per Rules & Regulations Rule 16: pet ownership is permitted at the discretion of the resident owner or absentee owner, subject to the restrictions below and all applicable NC State and Cumberland County Animal Control regulations.

Can I have a pet? Yes — limits apply

Dogs and cats are permitted. Maximum of 2 pets per unit, with neither pet exceeding 25 lbs at full-grown weight. Medical and assistance dogs are permitted but must be registered at the management office.

Do I need to keep my pet on a leash? Yes

All pets — including cats — must be kept on a leash when outside the unit at all times. NC State and Cumberland County leash laws are strictly enforced.

Where can my pet relieve itself? Limited areas

Pets must not be allowed to urinate on landscaping. Manure must be placed immediately in a plastic bag and deposited in the dumpster. All solid waste must be picked up immediately — this is the pet owner's responsibility, not maintenance staff's.

Can I leave my pet outside or on my patio unattended? No

Pets may not be left on patios, decks, or balconies while the resident is not home. Pets may not be left outside on restraining devices.

Can I have more than 2 pets or a pet over 25 lbs? No

The limit is 2 pets per unit, maximum 25 lbs each at full-grown weight. Violations may result in written notice, fines, and ultimately required removal of the pet from the property.

Can I breed animals or board pets for profit? No

Breeding, boarding, or raising animals for profit or resale is strictly prohibited.

Rule 16
What happens if my pet causes a disturbance or damage? You are liable

Residents are fully responsible for the conduct and any damage caused by their pets. This includes damage to common areas, landscaping, and neighboring units. The Association may pursue cost recovery and require removal of the animal for repeated violations.

Noise, conduct & common areas

Per Rules & Regulations Rules 6–11: residents are responsible for their own conduct and the conduct of their guests at all times. Living in close proximity requires courtesy and consideration for neighbors.

Are there quiet hours? Yes — after 10 PM

Stereos, radios, televisions, musical instruments, and similar items must be turned down after 10:00 p.m., and kept at a level that does not annoy occupants of neighboring units at all times.

Rule 9
Can I use weapons or noisemakers on the property? No

The use of rifles, B.B. guns, pellet guns, slingshots, firecrackers, or any comparable weapons or noisemakers on the premises is strictly prohibited. Violators will be assessed for any damages that occur.

Rule 4
Can I store items on my patio? No

All patios must be kept clear and free of toys, appliances, mops, rugs, trash, boxes, auto parts, tires, or any items other than furniture designed for patio use. Plants and charcoal grills are acceptable. Hanging laundry on the patio is prohibited at all times.

Can I use a grill on my patio? Limited

Charcoal grills may be stored on patios but cannot be used within 10 feet of buildings or flammable surfaces. Always follow applicable fire safety codes for multi-unit dwellings.

Can guests use common areas without me present? No

Non-resident guests may not use Winding Creek common areas — including the pool — in your absence. Residents must accompany guests at all times.

Pool Rules
Can I run a business from my unit? No

Each unit is to be occupied only as a private dwelling by the resident and their immediate family. Any commercial enterprise whatsoever is strictly prohibited.

Rule 11
Who is responsible for my guest's or child's behavior? You are

All residents are responsible for the conduct of their children, guests, and their guests' children at all times. Children must be supervised by a responsible adult and not left on their own.

Can someone solicit in the community? No

No solicitation of any kind is permitted anywhere on the premises. If you experience solicitation, report it in writing to thewindingcreekhoa@gmail.com.

Are there wooded areas I should be aware of? Caution

The woods behind some units are very thick with natural underbrush. It is dangerous for children to play in these areas. Children should be directed to play in the open field at the end of the 595 and 591 buildings.

Rule 19

Garbage & property maintenance

Per Rules & Regulations Rules 5 and 7 and Declaration of Unit Ownership Article V: the Association maintains all common elements. Unit owners are responsible for interior unit maintenance, proper trash disposal, and compliance with all property rules.

How do I dispose of trash? Dumpsters — Tue & Fri

All refuse must be in sealed plastic bags placed in the dumpsters provided. Dumpster doors must be kept closed. Any box or article 18 inches or more square must be mashed, torn up, or broken into smaller pieces before disposal. Trash may not be left on porches, entranceways, or patios. Trash pickup is Tuesday and Friday each week — do not place trash beside dumpsters.

How do I dispose of large items like mattresses or appliances? You are responsible

Residents are responsible for arranging private removal of large items. The regular trash collector will not remove mattresses, appliances, or similar large items. Do not leave these items outside or beside dumpsters.

Can I dump fireplace ashes in the dumpsters or plant beds? No

Ashes must be deposited only in the ash cans located in the dumpster areas. Ashes must never be placed in regular dumpsters or dumped in plant beds or common areas.

Who maintains the exterior of my unit? The association

All portions of the property not included within the individual units are common elements maintained by the Association — including foundations, main walls, roofs, landscaping, pools, and all other common area facilities. Unit owners are not responsible for common element maintenance.

Am I responsible for water damage from inside my unit? Yes — you are liable

Unit owners are fully responsible for any damage to their unit or any other unit caused by water leaking from within their unit — including hot water heaters, air conditioners, washing machines, water lines, appliances, dishwashers, refrigerators, and any other appliance that uses or emits water or condensation. Owners are strongly encouraged to maintain adequate HO-6 insurance coverage.

Rule 15
Am I responsible if my heat/AC work damages a neighbor's storage room roof? Yes — you are liable

All unit owners are responsible for any damages to their neighbors' storage room roofs caused by work done on their own heat/AC units. Arrange all such work carefully and ensure contractors take precautions.

Rule 14
Can I direct or supervise maintenance workers or contractors? No

Residents may not direct, supervise, or attempt to control management employees or sub-contractors working on the property. Direct all questions, requests, and concerns to thewindingcreekhoa@gmail.com.

Rule 22
What should I do if there is an emergency in my unit or building? Call immediately

For emergencies involving safety hazards, flooding, fire, or any situation requiring immediate attention, call 910-987-2573 immediately. Do not wait for an email response in an emergency. For a medical emergency or immediate danger, call 911 first.

Who should I give a key to if I travel? Tell management

Let management know when you are away and provide the name and phone number of someone watching your home. Also give that person the manager's name and phone number. This matters in an emergency requiring entry to your unit.

Rule 20

Assessments & payments

Per Declaration of Unit Ownership Article IV: all unit owners are bound to contribute toward common expenses in proportion to their respective ownership interest in the common elements.

When is my HOA assessment due? Per Board schedule

Assessments are due and collectible per the schedule established by the Board of Directors. Payment is required by all unit owners proportional to their percentage interest in the common elements.

What happens if I pay late? Lien / legal action

Unpaid assessments remaining for 30 days or longer constitute a lien on the unit when filed in the Superior Court of Cumberland County. The Association may foreclose this lien. Interest accrues from the date of delinquency.

Can I avoid paying assessments by not using common areas? No

No owner may exempt themselves from contributing toward common expenses by waiver of use or enjoyment of common elements, or by abandonment of their unit.

Declaration Article IV, Section A
Who is responsible for assessments when a unit is sold? Both parties

The purchaser of a unit (other than via foreclosure) is jointly and severally liable with the seller for any unpaid assessments at the time of conveyance, without prejudice to the purchaser's right to recover from the seller.

Can the Association place a lien on my unit? Yes

All assessments and common expenses that remain unpaid for 30 days or more may be filed as a lien against the unit in Superior Court. Once filed, this lien is prior to most other liens except real estate taxes and recorded mortgages.

Am I required to carry insurance on my unit? Strongly recommended

Every owner is strongly encouraged to maintain liability and property damage insurance on their unit. HO-6 broad form coverage with adequate liability is recommended to cover interior damage, water damage liability, and personal liability.

Rule 15

Violations & enforcement

Per Declaration of Unit Ownership Article X, Section B: failure to comply with any governing document provision is grounds for a civil action to recover sums due, for damages, or for injunctive relief — maintainable by the Manager, the Board, or an aggrieved owner.

How are violations reported? Email management

All violations must be reported in writing to thewindingcreekhoa@gmail.com. Do not report directly to Board members. Include the unit address, the nature of the violation, and any supporting details. We follow up within 2 business days.

What happens when a violation is reported? Formal process

A four-step process, set out in full below: notice, written notice with possible fines, corrective action at the owner's expense, and finally legal action or injunctive relief for continued non-compliance.

Can a non-compliant modification be required to be removed? Yes

Any unauthorized exterior modification, structure, or alteration made without Board approval may be required to be removed or restored at the owner's expense. Unauthorized modifications also void the Association's maintenance responsibility for those affected areas.

Can the Board pursue legal action against a unit owner? Yes

The Board of Directors may maintain a civil action against any owner to recover unpaid assessments, enforce compliance with governing documents, seek damages, or obtain injunctive relief. These rights apply to both owners and tenants of owners.

Enforcement

The violation process

  1. Resident receives on-the-spot or written notice of the violation.
  2. If the violation persists, a written notice is issued and fines may be assessed per the Board's fee schedule.
  3. If uncorrected, the Association may take corrective action at the owner's or unit owner's expense.
  4. Legal action or injunctive relief may be pursued for continued non-compliance.
